On Monday, June 11, 2018 the Melbourne Police Department responded to a call from residents in the Eagle Lake Subdivision that a neighbor had killed several ducks in his back yard. Upon the officer’s arrival, he discovered the suspect, Marrero-Pena, standing next to a dead adult duck and several ducklings. Marrero-Pena told the officer that he killed the adult duck by beating it with a stick and stomping the ducklings because they came on his property and the adult duck attacked him.
Marrero-Pena was arrested without incident for Florida State Statute 828.12 Aggravated Animal Cruelty for killing the ducks by beating and stomping them repeatedly which does not afford a swift, painless, or humane death and violation of City of Melbourne Municipal Code 10.2. that designates the City as a wildlife sanctuary where no birds or animals shall be intentionally killed or injured.
Marrero-Pena was taken into custody without incident and turned over to the Brevard County Jail.
